A wheelchair-bound pedestrian has recently decided to file a personal injury lawsuit in Blount County Circuit Court after she was hit by a dump truck approximately one year ago. April Sharice Warren, who is named as the plaintiff in the case, had been attempting to cross the street in front of Blount Memorial Hospital located at 907 E. Lamar Alexander Parkway at around 12:35 p.m., according to The Daily Times. When Warren approached the crosswalk, James Hatcher, who was behind the wheel of a Mack dump truck, was sitting at a traffic light.
The source stated that after Warren entered into the crosswalk, Hatcher proceeded to drive forward on a green light and struck Warren while crossing the road in her motorized scooter. The news outlet stated that “the scooter tipped over and the front left tire of the dump truck ran over Warren’s leg. When police arrived at the accident scene, Hatcher told officials that he did not see Warren, but that “he did stop when he heard the collision.” Warren was transported by an ambulance to the University of Tennessee Medical Center and was said to have been in stable condition the following evening after the crash.
After Warren had certain medical treatments rendered, she found that she had accrued nearly $237,000 in medical expenses and proceeded on to file a lawsuit against the owner of the dump truck company, C&C Trucking Contractors Inc., as well as Hatcher. Warren is now seeking “$3.5 million in compensatory and punitive damages on personal injury and permanent impairment claims.” The lawsuit accused Hatcher of “negligence and failure to yield the right of way as Warren was lawfully crossing the road.”
